Age-restricted products are some of the most profitable categories online: vapes, e-liquids, alcohol, CBD, knives, adult products and more. They're also the categories where getting age verification wrong can cost you your payment processor, your shipping carrier, or a large fine.
In the US there is no single age verification law for online stores. Instead, there's a mix of federal rules for specific products, state laws, and requirements from payment and shipping providers. This guide explains how it fits together.
Level 1: The Age Gate Popup
The most basic tool is an age gate: a popup asking "Are you 21 or older?" or asking for a date of birth before entering the store. It does three useful things:
- Signals clearly that your store is for adults only.
- Helps meet the expectations of payment processors and app stores.
- Creates a record that visitors confirmed their age.

Level 2: Verification at Checkout
For some products, a self-declared age is not enough. The clearest example is vapes and e-cigarettes.
Under the federal PACT Act, online sellers of vapor products must:
- Verify the buyer is at least 21 using a commercially available database or government ID, not just a birthday field.
- Use a carrier that requires an adult signature (21+) on delivery. USPS cannot be used for these products.
- Register with the ATF and the tax administrators in each state they ship to, and file monthly reports.
Penalties can reach $10,000 per violation or 2% of gross sales, plus state penalties. Many states also restrict or ban online vape sales entirely.
Alcohol is regulated state by state. Direct-to-consumer wine shipping is allowed in most states with licences, while spirits and beer are far more restricted. Delivery usually requires ID checks and adult signatures.
Level 3: Platform and Processor Rules
Even where the law only requires an age gate, your payment provider may require more. Shopify Payments, Stripe and PayPal all have restricted business lists, and high-risk categories often need a specialist processor that asks for documented age verification. Carriers like UPS and FedEx have their own contracts for age-restricted shipments.
How to Set Up Age Verification on Shopify
- Add an age gate that appears before visitors can browse age-restricted products. Make it accessible, mobile-friendly and fast, so it doesn't hurt your SEO or conversions.
- Target it correctly: show it store-wide, or only on restricted collections and products, depending on your catalog.
- Add checkout verification for products that legally need it (vapes, alcohol), using an ID verification service that integrates with Shopify.
- Block restricted destinations: use shipping zones and checkout rules to stop orders to states where you can't legally ship.
- Set up adult-signature shipping for the products that require it.
- Keep records of verification results and delivery confirmations.

- Age gates that block search engines from crawling your store, hurting SEO.
- Shipping to states with online sales bans because shipping zones weren't updated.
